Jury listens to entire Tai Chan recording: “He tried to kill me,” former deputy is heard saying

The much-disputed audio recording that led to an argument between prosecutors and defense attorneys was played in its entirety during the Tai Chan murder trial Wednesday.

Chan is a former Santa Fe deputy accused of shooting and killing his partner Jeremy Martin in 2014. The two were spending the night in Las Cruces after transporting a prisoner to Arizona.

The two deputies allegedly got into a drunken argument while staying at the Hotel Encanto. The prosecution says Chan shot Martin five times in the back. Chan’s defense says he acted in self defense.

Last year’s trial ended in a hung jury.

As ABC-7 reported, the prosecution only played the jury a few minutes of Chan’s arrest audio recorded from an officer’s lapel pin when it was abruptly turned off Monday.

The defense argued parts of the recording, where Chan claims he acted in self defense, were cut out after last year’s trial.

District Attorney Mark D’Antonio told the judge it was a mistake and not intentional.

Wednesday, the jury finally got to hear the 58 minute recording, which included Chan’s self defense claims.

In the recording Chan says, “He tried to kill me.”

Chan also screams, “I’m a victim man!” while handcuffed in the back of a police car.

The former deputy repeatedly shouts, “I’m a cop, I’m a police officer! I did what was right, I tried to do what was right, man.”

Las Cruces Police Officer Jared Cosper testified Chan appeared intoxicated that night.

“He had a slurred speech,” Cosper said while acknowledging Chan was able to walk down a long flight of stairs without any problems.
