Documents: 2-month-old dies; injuries consistent with baby being shaken
Court documents state the two-month-old Clint boy who died in July sustained injuries consistent with “being shaken.”
On Wednesday, October 19, 2016, deputies arrested Ruben Mojica, 28, and charged him with Capital Murder.
Deputies also arrested Christina Perez, 28, and charged her with “Injury to a Child by Criminal Negligence Resulting in Bodily Injury.”
On July 21, 2016, Sheriff’s Deputies responded to a report of an “unconscious person” at the 1500 block of Fitzroy Dr. in Clint.
When deputies arrived, Perez told them her two-month-old son had stopped breathing. The child was transferred to Del Sol Medical Center, then University Medical Center.
Sheriff’s office detectives who arrived at UMC to investigate the case were told the child suffered “fractures in his upper and lower extremities that showed to be in different stages of healing,” the court document states.
Investigators were also told the child had fractures in the rib area “not consistent with CPR being performed.” The complaint affidavit also states “additional medical findings at UMC showed the 2-month-old victim had sustained a brain bleed and retinal hemorrhaging.”
The medical staff at UMC told investigators the injuries were consistent with the baby being shaken. The child was pronounced dead on July 22, 2016.
Three days later, Perez told a sheriff’s office detective she was unaware her two-year-old was injured and could not account for all of the injuries discovered at UMC.
Perez told investigators she had left the baby in the custody of his father. The baby was alive and well when she left, the woman said.
When investigators spoke with Mojica, he allegedly acknowledged he was the only person taking care of the baby the night of the alleged abuse.
Documents state Perez told detectives that on one occasion, she was carrying the child in her arms and noticed he was “tender to her touch around his back area.”
“It felt as if though the baby had a broken bone in his back,” Perez allegedly told the detective.
Perez allegedly said she thought nothing of what was felt on her son’s back, but did acknowledge she noticed bruises on his body several times.
The sheriff’s office said an investigation revealed Mojica is to blame for the child’s death.
Court documents obtained by ABC-7 state Mojica was charged with “Terroristic Threat of a Household Member” more than two months after the death of his son.
On September 28, 2016, Mojica’s cousin, 38 weeks pregnant at the time, said she woke up when Mojica entered her room and demanded a card for a television. Mojica allegedly grabbed the woman by the arm and pulled her off the top bunk bed.
When the victim’s mother intervened, Mojica allegedly smashed a flat screen television and tried to break a glass sliding closet door.
As he walked away, Mojica allegedly threatened the victims by saying he had a shotgun and was going to shoot them. Mojica allegedly said he would also “get his people on her.”
Mojica was booked into the El Paso County Detention Facility without bond. Perez was booked into the El Paso County Detention Facility under a $100,000 bond.
