man accused of causing a deadly car causing a deadly car crash on the morning of christmas eve will appear in court this morning. police say 24-year- old joel garcia was drunk when he ran a red light and crashed into a car killing three people in east el paso. he’s charged with three counts of intoxication manslaughter. the trial has been on hold pending a ruling by a texas court of appeals — on an appeal filed by the state. in a copy of the state’s lab report, garcia’s blood alcohol content was more than three times the legal limit. — back in july — judge gonzalo garcia threw out several key pieces of evidence — including the blood sample. the judge ruled it was taken without a warrant. the judge also dismissed a confession garcia gave to police because his miranda rights had not been read to him. from our new mexico mobile newsroom– a man who attacked an elderly couple with a hammer back in 2014–now knows how long he will spend behind bars. -but before guy young learned his sentence in court yesterday he apologized to his victims. . “first off i would like t apologize to mr and mrs green. i’m sorry it’s something i’ve never done before. there’s nothing i can say to make it right.” young was convicted of attacking an elderly couple in new mexico and now he has been sentenced to 34 and a half years in prison. prosecutors say in june of last year — the 44-year-old attacked a couple with a hammer after he broke into their home. young will first serve a 22 year sentence in otero county for a separate conviction –then he will serve the 34-and -half year sentence handed down to him. / a man convicted of murder will have to wait a little longer to learn his punishment. luis castruita was convicted last week for the death of 22- year-old efren gonzalez. police say castruita shot gonzalez — who you see in this photo — back in march of last year. the two men got into a fight at a bar in the cincinnati entertainment district. the sentencing phase will continue this morning because prosecutors told the judge they are flying in more witnesses. now to an abc-7 update on one of the el paso teenagers accused of carrying out a string of robberies last month. this is video of the teens in court in alamogordo last month that you’ll see only on abc-7. we learned yesterday– 14-year-old jaquil webb had a hearing in alamogordo yesterday where he pleaded guilty to aggravated assault with a deadly weapon, possession of stolen vehicle and tampering with evidence. he and 4 other teens are accused of robbing 4 el paso businesses before leading authorities on high speed chase that ended in new mexico near alamogordo. we’re told plea offers have been extended to the other defendants. no word on when the suspects will be extradited back to el paso to face charges here. / / three people in alamogordo are accused of abusing a child. wesley roller — seth ham — and brittany horton are each charged with one count of child abuse … conspiracy to commit child abuse… and duty to report child abuse. police say their investigation began on october 25th after they got a report of a child being allegedly abused by adults living at the home. all three are behind bars on a 25- thousand dollar bond each. happening today—the canutillo highschool student who died last week on i-10 near redd road will be honored with a balloon release ceremony at the school. 14-year old diego fernandez was killed when police say the truck he was riding in hit the back of a semi-truck. his mother, simona fernandez-alacala was driving at the time. her husband was also a passenger. we learned yesterday they are both in stable condition. the balloon release at the high school will take place at 2:30 this afternoon. / happening today– congressman beto r’ourke is set to announce a plan that could improve veterans’ access to health care here in el paso. he’ll be releasing the details at a news conference this afternoon. good morning el paso’s denise olivas is live with a preview …denise? congressman bet o’rourke calls the long wait times for veterans at the local v-a cris– part of his proposal included establishing a home base operations center for the v-a here at the texas tech university health sciences center. his plan includes working with all local hospitals like william beaumont army medical center and university medical center. last year the department of veteran affairs released a national audit – revealing that el paso’s va was among the worst in the state and the country when it came to wait times veterans. the goals of the program include: – developing a better understanding at the va for the highest demand injuries, conditions and disabilities unique to veterans. – improving access to care immediately and bring improved facilities and focus to
