Document details wild, aggressive moments leading up to death of Horizon City man

A complaint affidavit obtained by ABC-7 states Oscar Armando Munoz, 20, killed David Adrian Hernandez, 21, by “placing the victim in a choke hold and impeding the victim’s ability to breathe.”

Horizon City Police arrested Munoz Saturday June 25, 2016. He was charged with manslaughter, a second degree felony. Munoz was booked into the El Paso County Jail with bond set at $100,000.

Saturday morning, officers responded to a call of a “suspicious person” in the area of Valle De Bravo and Desierto Bueno streets.

The affidavit states a homeowner on the 14300 block of Antwerp told police he saw a man, later identified as Munoz, knocking on his neighbor’s doors, yelling “help me!”

Police officers located Munoz nearby. He was reportedly on the ground “crying, screaming, and sweating profusely with various scratches on his face, neck, and red, bloodshot eyes.” Munoz asked officers to go down the street to check up on his cousin. When asked what happened to his face, Munoz allegedly said, “he tried to kill me.”

While in the back of the patrol unit, Munoz allegedly told officers he had placed his cousin in a choke hold because “he wouldn’t let him go free … and that he wanted to sleep with him.”

Police allegedly found a grenade-shaped marijuana grinder on Munoz. When asked if “he was on something,” Munoz allegedly said he smoked a tobacco cigarette and “didn’t know if it was weed.”

When asked again what had happened to his face, Munoz allegedly said the person who attacked him wanted to poke out his eyes.

The officers were then directed to the 700 block of Maravillas Street in Horizon City, where they found an unconscious man inside the home.

The Horizon City Fire Department and Life EMS ambulance responded to provide medical assistance. The victim, Hernandez, was taken to Del Sol Medical Center, where he was pronounced dead.

Under interrogation, Munoz told police he wanted to hang out with Hernandez because Hernandez was going to have court soon. Munoz said they spent time together with two female cousins and had some drinks at a club named Tequilas.

Afterward, the allegedly went to Hernandez’s home where Hernandez allegedly started calling Munoz “Cynthia” and became “physically aggressive with him, pushing him and putting his hands on him.”

Hernandez allegedly asked Munoz to sleep next to him. Munoz agreed in order to “diffuse the situation.” Hernandez allegedly forced Munoz into a bedroom and refused to let him leave. At this point, a struggle ensued with Hernandez allegedly trying to poke out Munoz’s eyes, the document states.

Munoz allegedly said he choked Hernandez and it wasn’t long before he noticed Hernandez was no longer resisting.

Munoz asked Hernandez if he was okay, but his cousin did not respond. Munoz told police he got Hernandez’s keys and cell phone and took off. He then proceeded to knock on the doors of surrounding homes to ask for help.
