Details revealed about migrant shooting in Hudspeth, brother claims they were hunting; officers note inconsistencies

HUDSPETH, Texas -- ABC-7 obtained documents that reveal more information about the shooting incident that killed one migrant and injured another.

The shooting happened Tuesday evening south of Sierra Blanca in Hudspeth County.

An affidavit ABC-7 obtained states that the shooting happened around 7 p.m. on Tuesday.

A group of migrants traveled in the desert when they stopped to drink water. It was a group of 13 Mexican migrants.

The affidavit claims a vehicle passed the migrants, and they took cover to avoid being detected.

The vehicle backed up, and the driver exited the vehicle. The driver leaned on the hood of the car and fired two shots at the migrants.

The driver re-entered the car and left the scene.

One male migrant was struck and died at the scene. Another female migrant was shot and is now recovering in Del Sol Hospital in El Paso.

Authorities interviewed the migrants about the incident. They said they heard the one of the men shout insults at them.

They also said they revved the engine of the truck. Agents checked the cameras and located the vehicle. They made contact with the owner, Michael Sheppard.

Sheppard, the former warden of the West Texas Detention Facility, was reluctant to speak about the incident and left.

Mark Sheppard, Mike's brother, was also interviewed.

He first told agents he was never in the location where the shooting happened.

He later changed his story and admitted he and his brother were together the night of the shooting, according to the affidavit.

Mark said they were looking for ducks, then changed it to birds and then to javelinas.

Mark said Michael exited the vehicle and fired two rounds. According to the document, Mark asked Mike "did you get him?" then he changed "him" to "it."

Officials asked Mark if they checked to see if they had shot anything, and he said they did not.

Mark said he failed to report the incident to any law enforcement.

Both men are facing manslaughter charges. They are now in the El Paso County Detention Facility.

The Texas Rangers continue to investigate the shooting.

Congresswoman Veronica Escobar is calling on the Department of Justice to investigate this as a hate crime.
