Man arrested for allegedly pointing gun at child, Las Cruces Police say

Las Cruces Police have charged a 24-year-old man with child abuse and other charges after he allegedly pointed a gun at his girlfriend’s brother while the brother was holding a baby at the time.

Rudolfo Montoya, of the 400 block of N. Virginia St ., has been charged with one count each of intentional child abuse, aggravated assault with a deadly weapon and battery.

According to Las Cruces Police, on July 21 Montoya went to a laundromat on south Espina Street where his girlfriend and her 26-year-old brother were washing clothes. Montoya allegedly began arguing with his girlfriend and then punched her brother who was holding a young niece.

Police said that Montoya then got a handgun from his vehicle and pointed it at the man who was still holding the young girl.

No shots were fired and no injuries were reported.

Montoya fled the scene but was arrested by police on a warrant July 27. A 9 mm handgun was located in his vehicle.

Montoya was transported to the Dona Ana County Detention Center with bond set at $15,000.
