Man Acquitted of Raping Las Cruces Woman

A man has been acquitted on charges of raping a 22-year-old woman in Las Cruces.

El Paso attorney Randolph Ortega says 20-year-old Cody Gregory Highfill was found not guilty of criminal sexual penetration by a jury on Thursday.

Police say a woman told them in October 2013 that she was drinking in a Las Cruces apartment with Highfill and another man and became heavily intoxicated.

Las Cruces police said Highfill and two other men sexually assaulted the woman, then carried her to her apartment in the same complex and sexually assaulted her again.

But Ortega says testimony at Highfill’s trial made it “pretty clear that the entire episode was consensual.”
