Trial begins for LCPD officer caught on camera beating handcuffed suspect

Trial began Tuesday for Richard Garcia, one of two Las Cruces Police officers caught on camera beating a handcuffed suspect while in holding cell in 2014.

Ross Flynn is now suing the Las Cruces Police Department for $12.5 million.

The video shows two officers throw Flynn up against the wall and onto the floor, breaking bones and sending him to the hospital for days.

Flynn was being held as a suspect in a dispute with a neighbor involving a weapon, and was handcuffed around the waist with his hands in front.

In April, Flynn was sentenced to 364 days supervised probation and 80 hours community service for his role in the events leading to his arrest.

Garcia is facing one count of aggravated battery resulting in great bodily injury, a third degree felony. If convicted he faces up to three years in prison.

Trial for the second officer in the video, Danny Salcido, will begin in 3 weeks.
