Complaint Affidavit: Anthony hit-and-run driver “heard a boom and got scared”

The man charged in connection with a deadly hit-and-run told police he heard a loud noise outside his truck and could not sleep the night of the crash.

Police arrested Jose Bricino, 53, and charged him with “Failing to Provide Aid” and “Fleeing the Scene of an Accident Involving Death.” Authorities say Bricino is the driver who struck six-year-old Sebastian Angel Fragoso Thursday night.

Fragoso was riding his bicycle at the corner of Putter Circle and 4th Street when he was struck. The boy was taken to the hospital where he died following surgery.

“It appears when Sevastian made a left turn onto Fourth St., he made the turn directly into the path of the white truck. Sebastian went head-on to the truck’s right front section,” a court document states.

According to the criminal complaint obtained by ABC-7, Bricino told police “he heard a boom and got scared. “

Bricino allegedly admitted to investigators that when he got home, “his son showed him a photo of his truck from the surveillance video.” Bricino said he could not sleep that night and wanted to file a police report the next day, the criminal complaint states.

Police said Bricino did have a cell phone and had the opportunity to report the crash but failed to do so. The court document also states Bricino admitted to police he noticed the damage to his truck.

An anonymous tip led police to Bricino’s truck in Anthony, New Mexico. The complaint affidavit states the truck had fresh damage to the grill and was missing a piece, with the victim’s blood, found at the scene.

Officers tracked down Bricino at a metal factory where he works, according to the complaint affidavit.

“We’re torn,” Sebastian’s father, Sebastian Fragoso, told ABC-7 Friday. “We’re in a lot of pain. I miss my son. I want to see my son. I want to see him running, but I can’t, I can’t.”

“Empy, I feel empty. He was a piece of my flesh,” the boy’s mother, Guadalupe Fragoso said. Guadalupe allegedly told police she was inside the home when her son was run over. The father told ABC-7 he was at work.

A 13-year-old boy witnessed the crash and ran to tell the victim’s brothers.

Sebastian’s parents told ABC-7 Sebastian loved to play outside. He was full of life and had a laugh that could light up the room, his parents said.

“When I came from work he would always go and find me, just his smile, his hugs, I can’t hug my kid anymore,” Fragoso said.

Luis Villalobos, a spokesman with the Gadsden Independent School District, told ABC-7 the Fragoso was a student at Gadsden Elementary School.
