Man takes plea deal in baby’s death; capital murder charge dismissed

The man in jail for the death of an 11-month-old baby girl in 2012 pleaded guilty Wednesday to “reckless injury to a child.”

Irving Aaron Gomez, 25, was originally charged with Capital Murder. He made a deal with prosecutors and was sentenced to 7 years in prison,

Gomez, jailed since his arrest, will be given credit for time served, a spokeswoman with the district attorney’s office told ABC-7.

Police said the baby died the morning of September 7, 2012 after the man taking care of her, Gomez, stuck his finger down the girl’s throat to keep her from crying. This happened at a home in the 2600 block of Nations, police said.

Gomez did not remove his finger until after the baby, Nevaeh Martinez, stopped breathing, police said.
