Some charges dropped against doctor accused of fondling patients

The doctor accused of fondling his patients is now only facing a maximum of three years in prison if convicted.

Doña Ana County prosecutors told the ABC-7 New Mexico Mobile Newsroom crew that the judge ordered late Thursday night that four kidnapping charges be dropped against Dr. Robert Woody.

The kidnapping charges carried 18 years maximum, each.

Woody now only faces misdemeanor counts of criminal sexual contact, which means he faces a maximum of three years if convicted.

Prosecutors said the judge can make that order after finding that no reasonable jury could reach a decision to the contrary.

The jury will get instructions this morning, followed by closing arguments.
