AG wants judge’s order overturned in child pornography case

The New Mexico Attorney General wants the state Supreme Court to vacate a judge’s order regarding evidence in a child pornography case.

In court documents filed Wednesday, state prosecutors say a Bernalillo County judge ordered them to turn over images of child sexual exploitation in the case involving defendant Bobby Murphy.

According to court documents, he has been charged with a count of possessing child pornography and a count of attempting to distribute it. The evidence order came in response to a motion from the defense.

The Attorney General’s office says the order would result in its prosecutors having to make copies of the evidence, which they argue is a possible violation of state and federal law.
