Former coach accused of hosting party, allowing teens to drink alcohol and smoke pot

Police are accusing a former recreation-league football coach of allowing minors to alcoholic beverages during a party at a vacant rental property.

Shortly after 2 a.m. on July 4, 2018, Las Cruces police received a call of a rowdy party at a home on the 1800 block of Myrtle Avenue. Police arrived to see about 40 people at the home. Most of the people in attendance fled without being identified.

Police said the host, and former coach, 31-year-old David “Day-Day” Spears, met police at the front door and allegedly told several teens to hide in bedrooms.

Investigators believe Spears, of the 4000 block of Canterra Arc, organized the party along with a 15-year-old girl and her 17-year-old brother. The mother of the teenagers owns the vacant rental property, police said. The 17-year-old boy was not present at the party when police arrived, a news release states. The girl reportedly obtained keys to the home and let Spears host the party that spread word on social media.

Investigators learned Spears allowed at least seven teens to consume alcohol or smoke marijuana during the party. Inside the home, police found a backpack that contained marijuana, a scale, and paraphernalia commonly used for distribution. A 15-year-old boy claimed the backpack and was issued a Class III citation for possession of a controlled substance.

Seven teens were also issued a citation for serving and consuming alcohol. Police believe the same rental property was used by Spears for another party was held last weekend.

Spears is charged with seven counts of contributing to the delinquency of a minor. All charges are fourth-degree felony counts.

On Wednesday morning, Spears was booked into the Doña Ana County Detention Center and is initially being held without bond.
