Teacher made contradictory statements to detectives looking into child sex case, affidavit states

A Las Cruces elementary teacher allegedly made contradictory statements to investigators looking into a child sex abuse case involving the woman’s husband, a criminal complaint affidavit obtained by ABC-7 states.

Investigators said the alleged abuse went on for years and began when the accuser was 12. ABC-7 does not identify victims of sexual abuse or the victim’s relation to the accused in order to protect the victim’s identity.

Detectives with the Doña Ana County Sheriff’s Department allege 43-year-old Jessica Biszick-Lee knew of the sexual abuse allegedly committed by 53-year-old Bruce Lee, arrested July 26, 2018.

Lee is currently being held at the Doña Ana County Detention Center on three charges of Criminal Sexual Penetration and a single count of Criminal Sexual Contact. Biszick-Lee is being held without bond at the Doña Ana County Detention Center on charges of Child Abuse and Obstruction of Reporting Child Abuse or Neglect.

Biszick-Lee is a teacher at University Hills Elementary, a Las Cruces Public Schools spokesman said. “The district’s number one concern is student safety, but we are unable to comment on personnel matters,” said Damien Willis, the director of communications at LCPS.

The investigators ordered a SANE exam on the accuser after the accuser, now 16 years old, told teachers at school about the alleged sexual abuse. The sheriff’s office says lab results confirmed DNA from Lee was found on the victim.

When first interviewed on July 26, 2018 about the latest accusations against her husband, Biszick-Lee allegedly told police, “I should have believed” the accuser.

According to court documents, Biszick-Lee called 911 in 2015 to report the sexual abuse of the child. At the time, the woman allegedly told an investigator she witnessed Lee sexually abusing the victim, 12 years old at the time. Lee was not charged because investigators learned the child was possibly lying.

During the police interview on the 26th of July this year, police asked Biszick-Lee about the police report filed in 2015. The court document states the woman said the investigator who filed the report in 2015 made a mistake because she never witnessed her husband sexually abusing the 12-year-old. Biszick-Lee allegedly told the investigator she did not want to discuss the allegations from 2015 and decided to end the police interview.

Investigators then obtained the 911 call allegedly placed by Biszick-Lee in 2015. The court documents obtained by ABC-7 state, that in the phone call, Biszick-Lee is heard telling the operator, “I just caught my husband molesting” the victim. Further, Biszick-Lee is allegedly heard telling the operator that Lee “has been doing that since he came back from parole. Apparently, it’s not the first time he’s done it.”

When the 911 dispatcher asked Biszick-Lee if she was aware of previous accusations, Biszick-Lee allegedly replied, “I was … and I did not believe (the victim) and I just caught him red-handed.”

Biszick-Lee was charged because her statements in the 911 call were “contrary” to comments she made during her most recent police interviews, th criminal complaint affidavit states.

A criminal complaint filed against Lee states the man told investigators the teenager has made multiple accusations against him in the past. The behavior began when Lee allegedly caught the teenager watching pornography, the criminal complaint states.

Lee also told investigators, that because of those accusations, he tried to stay away from the teenager and makes sure he is never left alone with the teen. Further, Lee said the latest accusations came after the teen’s phone was taken away as punishment.
