Grossman’s arena lawsuit could be heading to Texas Supreme Court

One of the lawsuits in the dispute to build an arena in the Duranguito neighborhood in Downtown El Paso could be heading to the Texas Supreme Court.

This is the fourth lawsuit involving Historian Max Grossman, who wants to preserve the neighborhood, and the City of El Paso. Grossman argues the City must let voters decide the issue in the November 2018 election because the required signatures were submitted to put the item on the ballot.

The City argues it is against the law to have voters decide zoning issues. The case this week ended in the Court of Appeals in San Antonio, which denied Grossman’s request.

“The Court’s order reaffirms the City’s position that calling for an election to decide zoning issues would violate state law,” said Interim City Attorney Karla Nieman in a news release.

Grossman says his legal team, backed by oilman and Texas history champion JP Byan, is preparing to go to the state’s highest court.

The deadline to place items on the ballot is Monday, August 20, 2018.
