Attorney General Comments On Border Shooting

Neither the FBI nor the Border Patrol wanted to comment about the cellphone video showing a Border Patrol agent shooting a 15-year-old, but Attorney General Eric Holder did talk about it Thursday.

“Well, I’ve only seen a bit of the tape; I’ve not seen it in its entirety, but that would be something that will obviously be examined as the investigation goes on. I won’t say that will be a critical piece of the investigation, because we don’t know what the dimensions of the investigation will be, but that will certainly be a part of what the investigators will look at,” said Holder.

There is a second video the FBI says was captured from the railroad bridge. On Tuesday, the day after the shooting, FBI spokeswoman Andrea Simmons described what happened after a Border Patrol agent saw smugglers working near the border.

“This one particular agent, who is a bike patrol agent, goes down to what we would call the cement apron that is basically the river bank for that part of the border. He is able to arrest one of the subjects that have been coming across. The others sort of scatter into different directions,” said Simmons.

The cellphone video then shows the agent trying to detain one of the suspects. The crowd watching from the bridge says they are throwing rocks at the agent.

Three shots are then fired by the agent; a man is then seen popping out from behind a pillar. Then, a fourth shot, which is believed to have hit 15-year-old Sergio Adrian Hernandez Guereca, is fired, killing him on the Mexican side.

The agent who fired his weapon is a seven-year veteran of the Border Patrol; authorities will not release his name in order to protect him. However, they did say Hernandez Guereca was in a list of ten immigrant smugglers since 2007.

For perspective, ABC-7 checked with the El Paso County Attorney’s office, who keeps tabs on drug traffickers, and there have been some as young as ten years old.
