Decision On Marmolejo Retrial Venue Still At Least Weeks Away

It will be at least another three weeks before we learn if and where the murder retrial of David Marmolejo will be.

He is accused off killing his mother, Gloria Marmolejo and dumping her body in the desert.

Marmolejo’s first trial ended in a mistrial when the jury could not reach a verdict.

On Thursday, Judge Gonzalo Garcia narrowed down the options to Austin, San Antonio or Houston.

Garcia said district courts in San Antonio and Austin are not available to accommodate a 2-week-long trial, but said he is checking the possibility of relocating the trial to a juvenile court.

Another option Garcia suggested is having the trial at the University of Texas School of Law in Austin, but cited security concerns. School officials confirmed trials have previously been held in the School’s courtroom, but said it would be difficult to clear out two weeks worth of events at the courtroom during the Spring semester for the trial.

If the trial is moved to Houston, defense attorney Greg Anderson said he would withdraw his request for a change of venue and opt for a trial in El Paso instead.

The next hearing is scheduled for Dec. 14.
