Court Document: Border Patrol agent admits taking child porn video featuring 5-year-old

A U.S. Border Patrol agent from Las Cruces was arrested and charged with child pornography after allegedly receiving the videos from a WhatsApp group post.

Officials with the U.S. Department of Justice announced Friday that Jason Christopher Davis, 45, made his first appearance Friday in federal court on a criminal complaint charging him with receipt of material containing or constituting child pornography.

They state Davis, who is employed as a Supervisory U.S. Border Patrol Agent, remains in federal custody pending a preliminary hearing and a detention hearing. They are scheduled for May 23, 2018.

The criminal complaint alleges that Davis received child pornography in April 2018, in Doña Ana County.

According to the complaint, the Las Cruces Police Department executed a search warrant on an email account Davis allegedly used to upload a video file containing child pornography on April 27.

Documents obtained by ABC-7 state the video featured two girls who appeared to be between the ages of 11 to 14 on a bed. One allegedly appears naked, rubbing another girl.

The complaint further alleges that on May 15, 2018, Homeland Security Investigations and the Las Cruces Police Department seized numerous items including digital media while executing a state search warrant at Davis’ residence.

Documents state, that during an interview conducted later with Davis, he admitted to receiving the pornography from a WhatsApp group post and that the video automatically saved to his phone. Davis allegedly stated that he did not want the video on his phone, so he emailed the video to his Gmail account and saved it on his computer.

Davis also allegedly admitted to taking videos of a 5-year-old that focused on the child’s exposed genital area. Davis allegedly explained he didn’t know why he recorded the video. Documents state he knew it was wrong yet saved the video on his laptop to view it.
