Marmolejo Retrial: Closing Arguments

With tears in her eyes and a picture of Gloria Marmolejo in her hands, Mary Rodriguez listened as prosecutors and the defense outlined their closing statements to the jury Monday afternoon.

David Marmolejo has been charged with murder in the July 2009 death of his mother, Gloria.

David’s family packed the inside of this courtroom, sitting behind the prosecution team, many of them crying as attorneys pointed out to the jury David’s phone records and his changing alibi.

Prosecutors placed another picture of Gloria in front of the jury from a flyer family members distributed when she went missing.

El Paso Assistant District Attorney Jennifer Vandenbosch said, “This is Gloria Marmolejo. This man right here killed her. We know this because of his statement and because of his call detail records. She arrived home home. She was never seen again. She talked to David Marmolejo. She was never heard from again. She was seen by David Marmolejo and she was never seen again.”

Defense attorney Greg Anderson Mariah Wilson used a shoelace — that was never examined by El Paso Police for evidence — to kill Gloria. Wilson is David’s stepsister and was his girlfriend at the time of his mother’s death. Family members have testified Gloria did not like the relationship between David and Wilson.

He showed the jury a picture of Wilson — her finger cut up and even questioned why she wasn’t put on the witness stand.

“One person could have cleaned up a lot of these issues. Mariah Wilson. So why didn’t the state call her? Either because they thought she killed Gloria Marmolejo or they couldn’t trust her.”

Wilson testified in the first trial in the fall under full immunity that David admitted killing Gloria and then Wilson helped dispose of the body.

Wilson could be seen crying in the courthouse hallway. She did not testify before the prosecution rested on Saturday and the defense rested Monday morning without calling her or any other witness to testify.

The seven men and five women on the jury begin deliberations Tuesday.
