Update: Public intoxication charge against boxer Austin Trout has been dropped

Jan. 3, 2013 update: The public intoxication charge against boxing champion Austin “No Doubt” Trout that was issued to him in El Paso on Jan. 1 has been dropped, according to Trout’s trainer.

Trout had been charged with public intoxication stemming from an altercation at a West El Paso Taco Cabana early Jan. 1. Trout denied the allegations from the start.

Trout, 27, of Las Cruces, was arrested at 4:34 a.m. Tuesday and booked into the El Paso County Jail at 8:50 a.m. He was released at 11 a.m. on a $105 bond.

According to the police report, several officers from the Westside Regional Command Center were called out to the Taco Cabana just down the street at 7800 N. Mesa in reference to a fight at about 2:30 a.m.

“Upon arrival Officer (Matthew) Jones observed several subjects including the listed offenders yelling inside the restaurant,” according to the police report. “Officer Jones entered the restaurant and observed several chairs, tables, food and drinks strewn about the floor.”

Restaurant employees identified the alleged offenders, including Trout, as having engaged in a physical altercation inside the restaurant.

Trout’s manager, Louie Burke, said the boxer was actually attempting to be a peacemaker.

“Austin says he was not drinking,” Burke told ABC-7. “He went out to eat, and an argument started at the table next to him. (Austin) tried to break up the fight. He did break up the fight actually. He asked the police officer what he was getting arrested for. He said, ‘Can you please give me a breathalyzer test?’ And the police denied him one.”

According to the police report “Officers Jones advised one of the subjects to exist restaurant in order to interview her as a witness to the incident. Listed offenders then became enraged and started to follow the officers outside. Officers attempted to gain control of the situation and tell several of the offenders to leave the area for the officers safety. Officers made contact with the offenders and smelled the strong odor of an unknown alcoholic beverage emanating from their persons. The offenders had loud slurred, speech and unsteady balance as they walked about the restaurant and parking lot area. Offenders were handcuffed and placed under arrest for their safety and the safety of others. Offenders were booked into the county jail.”

According to Trout’s Facebook page status on Monday, he planned on spending New Year’s Eve in El Paso.

“Going to Tricky Falls tonight … to usher in the new year. This year was great and looking for an even better year next. i would love to toast with all of you so come join my #CelebrationOfChampions!! ” Trout put as his Facebook status Monday at 7:43 p.m.

Trout defeated Miguel Cotto in early December in a 12-round unanimous decision at Madison Square Garden to retain his WBA World Light Middleweigh t Championship.
