Las Cruces man says singing got him a citation

One man’s singing may be yelling to another.

A Las Cruces man says he received a citation for violating the city’s noise ordinance because he and his brother were loudly signing while driving through an area where police were conducting a traffic enforcement operation.

However, police say Erick Alvarez actually received the citation Wednesday for yelling at a police officer.

The Las Cruces Sun-News (http://bit.ly/1rKdY78 ) reports that the officer who wrote the citation wrote “yelling & shouting” above a box for the ordinance.

It prohibits yelling, shouting or creating other loud noises that annoy or disturb the quiet and comfort of others.

Alvarez has to appear in city court by late April. The petty misdemeanor is punishable by a fine up to $500 and up to 90 days in jail.
