Feb. 3, 2015 story: An off-duty Border Patrol agent has been charged with two counts of criminal attempted murder after a SWAT situation that started Monday night and ended early Tuesday morning.

Alberto Montelongo was booked into the El Paso County Detention Facility on a $300,000 bond.

One of the victims was taken to the hospital where he is listed in critical condition.

Montelongo was arrested last Thursday on a charge of domestic violence and released Friday.

El Paso County Sheriff’s deputies were sent to the 13900 block of Bradley of Montana Vista at 10:45 p.m. Monday on a shots fired call.

Upon arriving, deputies were informed it was a domestic violence situation and Montelongo barricaded himself with two other people inside.

A Customs and Border Protection spokesman said in a statement that the incident in Montana Vista involved two off-duty Border Patrol agents.

“During the incident, shots were fired by an off-duty agent that resulted in an injury to a third individual at that residence,” according to the CBP statement. “The agent was arrested and currently faces charges related to the incident. Alberto Montelongo is a Supervisory Border Patrol Agent and is an 11 year veteran assigned to the Ysleta Station. CBP’s Office of Internal Affairs in El Paso also responded and is reviewing the case to determine if a concurrent investigation into employee misconduct is warranted. U.S. Customs and Border Protection is fully cooperating with the Sheriff’s investigation.”

Montelongo released the two victims after a few hours and he was later convinced by negotiators to surrender.
