Jury finds mother guilty of injury to a child in death of her 2-month-old baby
An El Paso jury found a Lindsey Hradek guilty of injury to a child – reckless in the death of her 2-month-old boy.
It is a lesser charge than the injury to a child with intent to cause bodily injury charge she also was facing.
The sentencing phase will begin at 8:30 a.m. Friday.
El Paso Police say Hradek and her husband, Bobby Soto, were allegedly high on cocaine and neglected to check on their son.
The boy was found dead back in 2012, strapped to an overturned car seat, under a pile of pillows.
A complaint affidavit obtained by the ABC-7 I Team at the time revealed the baby had been dead for several hours before his parents called 911.
In a recorded interview jurors listened to during the trial, Hradek says she woke up in the morning and noticed her baby’s face was purple.
She touched him and he was cold and she picked him up and he was stiff.
The jury began deliberations at about 10 a.m. today and at about 4 p.m. the jury requested to ask the judge a question.
They asked the judge what if they can’t arrive at a unanimous verdict even if more time is allowed.
The judge explained it would result in a mistrial but the indictment would still stand and another jury would have to go through the whole trial again.
The jury began deliberations again and was able to reach a unanimous verdict.
