Affidavit: Julian Tapia was driving 70-100 mph when he crashed into vehicle, killing 13-year-old

Jan. 21, 2014 Update: Witnesses say Julian Tapia was driving at speeds between 70 and 100 mph on North Loop when he collided into a vehicle, killing a 13-year-old, according to an El Paso Police affidavit.

A witness at the scene of the Jan. 18 afternoon traffic collision checked the condition of Tapia and “observed the defendant to appear to be intoxicated and the defendant admitted to the witness to having been speeding and drinking prior to the crash,” according to the affidavit.

A police officer at the scene “observed the defendant to have signs of intoxication.” The officer was not able to conduct field sobriety tests on Tapia because he was transported to the hospital.

The DWI Taskforce took a sample of Tapia’s blood at the hospital. The sample was to be sent to the Texas Department of Public Safety for analysis.

Police say that at about 4:26 p.m. on Jan. 18, Tapia, of San Elizario, was driving a Ford F150 in the 9300 block of North Loop when his truck struck the vehicle Pablo was traveling in.

Pablo and his 15-year-old sister, Isabel, were transported to hospital where Pablo died from his injuries. Isabel is in critical condition with multiple blunt force injuries.

Tapia had been receiving treatment at Del Sol Medical Treatment for injuries he sustained in the crash and was released from the hospital on Sunday evening.

Tapia has been arrested and charged with Intoxication Manslaughter.

He was booked into the El Paso County Detention Facility with a bond set at $100,000. Police say additional charges may be filed against Tapia.

Jan. 19 Story: El Paso Police say the boy killed by a suspected drunk driver yesterday was 13-year-old Pablo Hernandez.

Patricia Hernandez, 40, was driving with her son and daughter on the North Loop when their suburban was hit from behind by a 2009 Ford F-150.

The truck was driven by a 32-year-old man who has not been identified. Police say charges are still pending against the man and his name will not be released until he is booked.

The 15-year-old girl who was also in the back of the suburban along with her brother, is in critical condition.

Neither of the children were wearing seat belts.
