Attorneys representing Sun Metro explosion victims call investigation “unusual”
(UPDATE, 03-07-25, 8:55 P.M.) -- This evening, City Attorney Karla Neiman contacted Maxey Scherr regarding the investigation into the explosion. This is according to Scherr Law Firm.
Maxey Scherr sent ABC-7 this statement, saying:
"I wanted to update you all. After I spoke with you, I had a lengthy conversation with Karla Neiman, the City Attorney, directly. She assured me that the scene of the explosion has been preserved and that once the safety of the facility is confirmed, that our independent investigator will be granted access to conduct a cause and origin analysis.
My clients are looking forward to that opportunity."
EL PASO, Texas (KVIA) -- ABC-7 spoke to an attorney representing the victims of the Sun Metro explosion, Maxey Scherr of Scherr Law Firm.
Scherr says within days of the explosion she requested open records from the city such as: videos, witness statements, and data. She says she's worked on investigations but says the way the city is handling the investigation is unlike anything she's ever seen before.
"What's happening here is very unusual. To have received no response is unusual. To have received the very limited released that just happened yesterday is unusual," Scherr told ABC-7.
Scherr says she has requested a third party investigation to be conducted, but has not received a response from the city.
"Just So so that we're clear on this, it's not unusual to ask for an independent inspection. It's unusual to have no response," Scherr said.
City officials have said they did not want to release the records because ongoing investigations, anticipated litigation, and confidential and sensitive information.
