DOÑA ANA COUNTY, New Mexico -- The Doña Ana County Sheriff's Office confirms the death of Kim Yacone and the arrest of her husband, Bob Yacone. The Yacones were owners of a local Italian restaurant in Picacho Hills.

Sheriff Kim Stewart held a news conference Tuesday afternoon, in which she outlined the timeline of events. Stewart prefaced the news conference by saying the facts were dynamic and may not be as presented today as they learn more information. But in the interest of transparency, they wanted to provide as much information as possible.

According to Stewart, on Sunday, Sept. 18, Bob and Kim's son Nicholas called to say his mother had been severely injured and that there was a 12-gauge shotgun in the home.

Nicholas remained on the phone for seven minutes.

The couple's other son, Trent, went to a neighbor's home asking for help at 7:54 pm.

According to Stewart, at 7:58 pm, the first units arrive, aware that Bob is home.

Stewart says deputies made forced entry into the front door. Other units arrived on the back side of the home.

As deputies made their way into the master bedroom, they found Kim Yacone dead with injuries to her face and back. Based on the injuries, deputies knew they could not provide assistance.

Sheriff Stewart said Bob was on the balcony attached to the master bedroom. At 8:20 pm - a dialogue began between a trained crisis negotiator and Bob. Stewart said Bob indicated he had a handgun.

At 8:46, the crisis negotiator tells Bob to put the gun down, and 8 seconds later, shots are fired. Sheriff Stewart said she would not reveal who shot whom, but three deputies are on administrative leave.

Stewart says they provided Bob first aid and took him to the hospital, where he remains in stable condition. He is expected to survive.

A criminal complaint will be filed with the court charging Bob with first-degree murder, wilful and deliberate, and a felon with a firearm charge. He is under 24-hour guard.

On Tuesday, ABC-7 sources confirmed Bob and Kim Yacone were involved in the incident.
