Mother: 5-Year Old Daughter Sexually Assaulted By 7-Year-Old At Playground

EL PASO, Tx. -Amother contacts ABC-7 regarding a shocking allegation of sexual assault by a 7-year-oldagainsther 5-year-old at a northeast El Paso playground.

Amothercontacted ABC-7 to allege thather 5-year-old daughter was sexually assaulted by another child, who is just 7 years old.According to the parent compounding the assaultis that police say their hands are tiedand can’t do anything about it.

Because of the allegations in this story, the age of the victim and thealleged attacker, ABC-7 will not reveal the names of the persons involved.

According to the young girl’s mother it happened near a playground in a northeast El Paso housing community. She tells ABC-7, that several neighborhood children were playing Saturday afternoon.

The mother says at some point a 7-year-old boy pulled her 5-year-old daughter behind a nearby building and sexually assaulted her. The little girl says after the attack the boy told her if she told anyone about it – he would cut her mommy’s throat and tires.

The mother tells ABC-7,she is also concerned for the 7-year-old boy.

She adds, “The first thing came to my mind is who is doing it to him, that’s the first thing that came to my mind because my child don’t know about that for somebody else’s child is just 2 years older…where the hell he learning it?”

Then the victims’s mother says it gets worse as she alleges that the arriving officer told her, “this is not the first time this child has done this.” She says she was also told due to the Texas Family Code police can’t prosecute the boy.

EPPD Spokesman Chris Mears tells ABC-7, “Under the age of 10…you are not going to be adjudicated or charged with a crime in the state ofTexas.”

Mears adds, “We are not saying he’s untouchable…we are saying we can’t charge him criminally that’s not something that we decide.”

According topsychologist James Shutte, children under the age of 10 are at greater risk of continuing their behavior as adults.

It is that information that concerns the young victim’s mother the most. She tells ABC-7, “If he does it at 7 what will he do at 17? And let’s ask ourselves how many other people did he do it to?”

Duringtheinterview with the mother, a man identifying himself as the father of the 7-year-old came in to speak with the girl’s mother. He says his son is innocent.

The father spoke to the mother in front of the ABC-7 crew saying, ” I said did you touch that little girl…did you do anything wrong he said ‘not dadI touched her she was crying soI stopped her from crying.”

The father then turned to ABC-7 reporter Christina Boomer and said, “HonestlyI believe my son – I don’t know what to do what is there for me to do?”

The mother responded, “All I’m asking you from me to you please please have somebody talk to him – please.”

The father tells ABC-7 his son will see a mental health professional. He also said he believes his son learned to make the threat of slashing someone’s throat from listening to music.

Police say they can’t confirm or deny the 7-year-old has been accused of sexual assault in the past because of his age.

In the meantime, while the police department says cases such as this are forwarded on to Child Protective Services for investigation – a spokesman forCPS said if the case does not involve a caregiver or family setting the police department investigates.
