Proximity Of Sex Offender Worries Las Cruces Daycare

LAS CRUCES – Staffers at a Las Cruces daycare centersay they’ve seen a convicted sex offenderpark his car intheir parking lot, and they say they’re amazed there’s nothingin statelawthat prevents him from coming so close to their operation.

Authorities with Alpha School Daycare said when they sawDaniel Francis Hall, 32,on their property, they contacted the Dona Ana County Sheriff’s Department, but were told deputies could do nothing to prevent Hall from parking on the premises.

Hall was convicted on a charge ofstatutory rape in 2000, and served time in prison.

Sheriff’s officials said Hallcompleted hissentence, probation and parole terms, and under state law is free togo wherever he chooses, including near schools and daycares.

Officials at Alpha School Daycare said they’re bewildered by those findings.”I cannot believe that we are even having a discussion about this. Every parent that I’ve talked to has been appalled,” saidRay Jaramillo, director of the facility.

Dona Ana District Attorney Susana Martinez confirmed on Monday that Hall is in the clear “Unless specific conditions of probation or paroleis prohibiting him from being around children, which if those are over, then there will be no condition other than to register yearly,” she said.

Hall is out on bond after being arrested in July for not registering as a sex offender in Dona Ana County. Martinez says she is looking into whether parking by the daycare violates his release.
