Washington Man Sues Over Pool Accident

SILVER CITY, N.M. (AP) – A lawsuit filed on behalf of a Washington state man alleges he suffered permanent brain damage in a 2005 accident at the municipal pool.

The lawsuit filed in state district court in Silver City alleges the town and its employees were negligent in the case of Daniel Leon. A Las Cruces attorney who represents Silver City denies the town was liable.

The lawsuit seeks expenses for Leon’s medical care and treatment and pain and suffering. It alleges he was swimming in the Silver City pool in July 2005 when the female lifeguard left her post to talk for several minutes to the male lifeguard.

The lawsuit alleges she blocked his view of the pool. It says that by the time a lifeguard responded, Leon had been facedown in the pool for a prolonged period.
