Jury Enters Day Two Of Kirchner Sentencing Deliberations

After spending the night at a local hotel, a jury of eight women and four men was back at the El Paso County Courthouse Friday morning to deliberate a sentence for Travis Kirchner.

Kirchner, 58, was convicted Wednesday of murdering his mother, Patricia. The 81-year-old woman was found dead of carbon monoxide poisoning inside the garage of her home at the Poki Roni horse ranch in September of 2008.

The mother and son owned the property together.

Kirchner was found guilty after just 30 minutes of deliberations on Wednesday. The jury was sent back to the jury room shortly before noon on Thursday to come up with a sentence, but had yet to reach a decision by the afternoon.

Instructed to bring an overnight bag with them, the jury was then sequestered for the night.

Kirchner faces five to 99 years in prison and a fine of up to $10,000. According to court documents, he would become eligible for parole after serving half of the imposed sentence or 30 years, whichever is less.

During Thursday’s sentencing phase closing arguments, prosecutors called Kirchner a “frightening and unpredictable guy.”

Defense attorney Dolph Quijano told jurors that state’s pointed words for the defendant were meant to “distract” them and “misdirect” them from the truth.

The defense has always maintained that Patricia Kirchner’s death was part of a mother-son suicide pact that went wrong.
