Document: Teacher kissed and fondled student inside classroom storage closet

New Mexico State University Police arrested 30-year-old David Scroggs, a teacher at Arrowhead Early College High School, and charged him with four counts of Criminal Sexual Contact of a Minor.

Scroggs allegedly had a three-month relationship with a student at the high school and the sexual contact happened on school grounds, police said. Online jail records state Scroggs was released on a $25,000 unsecured bond Wednesday night.

Court documents state Scroggs is a history teacher and advisor for the student body government. The documents allege Scroggs and a 15-year-old student began “flirting” with each other in July and communicating online through a student/teacher communication system and Google Docs.

October 7, the victim said Scroggs told her he was interested in her. A few weeks later, he allegedly kissed her in the storage closet of his classroom.

The documents state they continued to kiss each other in the storage closet days after. The victim told detectives Scroggs later touched her inappropriately.

The victim, who Scroggs allegedly referred to as “his secret,” told police the inappropriate contact happened a few times.

The victim also alleges while communicating online, Scroggs told her “in the event that you ever did get caught, I would probably deny everything, as horrible as it sounds.”

Scroggs also allegedly told her “whenever we talk about sex like this, we should delete the Google documents after.

The documents state that when Scroggs was advised of the investigation while in his classroom during his lunch hour, he uttered the word “sorry” roughly two times to the investigator.
