Texas DA asks for recusal in case of pregnant wife’s slaying

HOUSTON (AP) – The case of a Houston-area man whose life prison sentence for the 1999 killing of his pregnant wife was vacated by an appeals court is expected to be handled by a special prosecutor.

Harris County District Attorney Kim Ogg on Friday asked that her office be recused from handling the case of David Mark Temple.

He’s accused of staging a burglary at his suburban Houston home and fatally shooting his wife, Belinda, because he was having an affair.

The Texas Court of Criminal Appeals last year ruled a prosecutor had withheld evidence from Temple’s attorneys.

Ogg asked to be recused because two of her staff members have ties to the case when it was initially tried.

A special prosecutor is now expected to decide if Temple will be retried.
