El Paso County sues Trump administration
El Paso County is officially taking the Trump administration to court.
The county — along with the Border Network for Human Rights — has filed a lawsuit against the president in response to last week’s national emergency declaration.
The legal team behind the lawsuit includes former acting attorney general Stuart Gerson and Harvard law professor Laurence Tribe.
Supporters of the lawsuit are seeking an injunction to block the emergency declaration by saying the president’s actions are not supported by law.
“You are going to have a massive presence of the military and you are going to have a state of war essentially against our community,” said Fernando Garcia, the executive director of the Border Network for Human Rights. “This is something that we can’t accept and we need to fight, and I think we are very confident that the courts will find that the president overstepped his authority. “
Language within the 39-page complaint requests a judge to declare the executive action “unauthorized and contrary to the constitution.”
