Judge Dismisses Lawsuit In Deadly Border Patrol Shooting

District Judge David Briones dismissed a $25 million wrongful death lawsuit against the United States for the shooting of a Juarez teen by a Border Patrol agent.

The shooting, which made international news and was videotaped on a cell phone, shows an agent approach a group of boys and detain one of them. The others begin throwing rocks at him from the Mexican side as he has his knee on the boy’s back.

The agent is seen raising his arm and firing at the group from the U.S. side, killing 15-year-old Sergio Adrian Hernandez Gueraca.

Briones dismissed the case because the teen was not shot on U.S. soil. As a result, he said, there are no statutes that would apply in suing the U.S. government.
