Las Cruces Man Arrested For Allegedly Physically Assaulting Stepfather

Las Cruces Police arrested a man who they suspect of attacking his 71-year-old stepfather as the two argued on Thursday, according to police officials.

Toby Ray Cox, 47, of the 1100 block of N. Miranda St . in Las Cruces, is charged with one count of aggravated battery causing great bodily harm.

Police said that Cox and his 71-year-old stepfather got into an argument on Thursday afternoon. The stepfather walked out of the front door of the home as the argument became heated.

Cox followed and allegedly attacked his stepfather from behind, putting him in a choke hold and tossing him to the ground, according to police.

Cox then allegedly punched his stepfather when he was on the ground.

Police said the physical assault ended when Cox’s mother yelled at him, demanding that he stop. The stepfather received non-life-threatening injuries to his face, head and neck.

Cox was arrested Thursday evening and was transported to the Dona Ana County Detention Center with bond set at $10,000.
