Las Cruces man charged with allegedly sexually assaulting adult relative

Las Cruces Police arrested a who allegedly forced an adult relative to submit to sexual intercourse.

Oscar Chavira, 45, is charged with one count each of criminal sexual penetration and battery against a household member.

According to police, Chavira and the woman had been drinking alcohol together late Sunday evening when Chavira apparently fell asleep.

Police say that at some point, Chavira awoke and wanted to have sex with the woman but that the woman did not want to.

Chavira then allegedly forced the sexual intercourse with the woman and allegedly slapped the woman’s face with the back of his hand, according to police.

Chavira was arrested Monday, April 7, and booked into the Dona Ana County Detention Center with bond set at $50,000.
