Man shot by Las Cruces Police faces felony charges

He was shot by a Las Cruces Police officer following an alleged armed robbery and now he’s facing a couple of felony charges.

Erik Daniel Hernandez, 19, is now charged with robbery and aggravated assault on a police officer.

He remains hospitalized in El Paso in critical condition.

Las Cruces Police say one of their officers, Officer David Rodriguez, shot Hernandez when he would not drop the knife he was holding.

It happened Friday night at a Valero corner store on Picacho Ave.

Rodriguez is on administrative leave while the case is investigated.
