Tai Chan Mistrial

trial. the jury came back just after three o’clock without coming to an agreement. they had to decide if chan shot and killed fellow santa fe sheriff’s deputy jeremy martin in self-defense… or if it was murder. the shooting happened two years ago inside the hotel encanto in las cruces. a jury forman told the judge they were split. one juror thought chan was guilty of first degree murder. six thought he was guilty of second degree murder. and five believed chan was guilty of voluntary manslaughter. the abc-seven new mexico mobile newsroom was the only el paso t-v station inside the dona ana county district court for the entire trial. now we know, a second trial is already in the works. tonight, we’re taking a closer look at what the mistrial means … and what happens next in the case. abc-7’s jamie warren just got all those details sorted out for us next at six. she’s live at the courthouse? after the judge declared a mistrial i saw tai chan here outside. he was smiling and surrounded by family giving him a pat on the back. chan remains a free man for the time being. his defense team says he remains out on bond and will likely be staying in las cruces until a new trial date is set. chan’s father and stepmother posted $600,000 worth of real estate to secure his bond. chan’s defense attorney john day tells me judge fernando macias’s court calendar is full for the next 6 months. he’s unsure when a retrial would take place. district attorney mark d’antonio says it all depends on the court’s schedule, his schedule and the availability of the defense. he says he should know more in the next two weeks sot full district attorney mark d’antonio i will in fact retry this case i will not consider a plea in this case unless the family is totally on board defense attorney john day think the results showed that a majority of the jurors listened to the argument and it came down to the fact that tai acted in self defense and i think the results speak for them self. the prosecution says it stands by its investigation, despite the defense accusation that it was full of holes. d’antonio says he’s not sure yet how much the trial cost his office. jamie, on this styory from start to finish. thank you for the complete coverage. abc-seven has a better idea of
