City reaches settlement with San Jacinto Plaza contractor
The city of El Paso is closing the books on the finances for San Jacinto Plaza after reaching a settlement with Basic ID IQ.
The $4.5 million renovation was completed a year and a half past deadline.
“Sometimes it was the contractor and sometimes not,” City Counselor Emma Acosta said.
Both the city and contractor had differing opinions on who was responsible for the delay damage and deductive change orders.
The city of El Paso claims the contractor owed $551,000, which included $264,000 in delay damage and $287,000 for deductive change orders. However, Basic ID IQ assert claims totaling $1,056,884 for additional work performed and the contract balance.
The contract balance (retainage) held by the city was $456,884, which was held until the completion of the project.
Both parties settled, and the contractor accepted the retainage as the full and final settlement.
“It was not 100 percent, but they agreed to end on friendly terms,” Acosta said.
