Man brutally beaten by former LCPD officers settles lawsuit with City of Las Cruces
The City of Las Cruces confirmed it reached a $400,000 settlement with Ross Flynn, the victim of a holding cell beating at the hands of two former Las Cruces Police officers in 2014.
Flynn, handcuffed during the beating, was originally suing the city for more than $12 million. Court documents obtained by ABC-7 state the parties involved agree to settle without admitting or conceding liability.
The officers seen in the surveillance video, Richard Garcia and Danny Salcido, were fired from the Las Cruces Police Department after a grand jury indicted them on charges of Aggravated Battery.
Garcia’s case went to trial but resulted in a mistrial. The cases against both officers were later dismissed in November 2016. In Garcia’s case, the former officer said he was trying to chain Flynn to a bench and never meant to hurt him.
Flynn suffered a brain hemorrhage, a cracked skull and several cracked ribs. He told ABC-7 in 2016 that he suffered from PTSD and blackouts.
Flynn was arrested by the police officers after a confrontation with a woman over a parking space at an apartment complex. In a 911 call, a neighbor says Flynn knocked on her door while holding a gun and acting aggressive.
Ross Flynn was charged with Aggravated Assault with a Deadly Weapon, Assault on a Peace Officer, and Resisting and Evading arrest. A jury only found Flynn guilty of resisting arrest and he was sentenced to 364 days of supervised probation and ordered to serve 80 hours of community service.
