El Paso businessman arrested on deceptive business practice charge

EL PASO, Texas — An El Paso businessman, who was the subject of a months-long ABC-7 investigation, was arrested on a deceptive business practice charge Wednesday and booked into an El Paso County jail. 

Mark Hernández, 43, owner of two now-defunct businesses, American Solar Group, and American Roofing Pros, is also accused of breach of contract and forgery, according to civil court records.

The criminal case that led to his arrest Wednesday accuses Hernández of taking over $30,000 for a roof replacement project, but only finishing 25 percent of the job. The police report for that incident was filed in August 2021. 

Police say Hernandez was arrested at 1:15 a.m. Wednesday at the Brew Sports Pub West off of North Mesa Street. A spokesperson for the El Paso Police Department told ABC-7 it was called after someone recognized him on TV as being wanted.

ABC-7 began looking into Mark Hernandez and his two businesses after two former customers reached out to us in late 2021 with concerns of fraud.

The county attorney’s office filed the criminal misdemeanor charge on February 17 and that prompted the arrest warrant.

Hernández was released from the Downtown Detention Facility Wednesday after paying a $3,000 bond.
