Las Cruces officials release video of officer-involved shooting that injured one man
UPDATE (November 16, 2024): The Las Cruces Police Department issued a statement clarifying the arrest and release of Danny Garcia De Leon.
In a social media post, Chief Jeremy Story stated Garcia was in custody for 12 hours and two minutes on two serious felony charges.
"A statement was printed that the District Attorney’s Office had not received intake on the case. The LCPD detective filed the paperwork by email with the District Attorney’s Office on November 12 before 8am and received a response from them minutes later," according to the post by the Las Cruces Police Department.
The office of District Attorney Gerald Byers also released a statement:
“After responding to a call for service at which an officer is reported to have seen De Leon point what was perceived to be a firearm at the responding officer; the officer subsequently is reported to have perceived a separate threat from De Leon, prompting his discharge of his service weapon, striking De Leon who was treated for his injury. Our Office received the felony intake package the same day the defendant had his felony first appearance on 11-12-24. Judge Kent Wingenroth denied the state’s motion for additional time for hearing a pretrial detention motion and released the defendant on his own recognizance in accordance with Supreme Court Rules. Pre-trial detention motions may be filed at any time and the case is being reviewed now for that purpose.”

Update (November 13, 2024): LCPD officials will hold a news conference on the shooting on Friday, November 15 at 9 AM. ABC-7 will provide complete coverage of the update.
Update (9:35 AM): After he was released from the hospital, police arrested 50-year-old Danny Garcia De Leon. Jail records show they charged him with Aggravated Assault On Peace Officer and Aggravated Assault and booked him into the Dona Ana County Detention Center without bond.
Police were first called out to the apartment complex on reports of an armed man yelling. Responding officers saw Garcia De Leon armed. Officials say an "incident" then resulted in an officer firing at least one round. Garcia De Leon was shot "at least once," police officials say. No officers were injured.
"The Dona Ana County Officer-Involved Incident Task Force made up of the New Mexico State Police, the Dona Ana County Sheriff’s Office, the New Mexico State University Police Department, and the Las Cruces Police Department are investigating the incident," a spokesperson for the Las Cruces Police Department explained Tuesday morning.

LAS CRUCES, New Mexico (KVIA) -- Officials with the Las Cruces Police Department said an investigation is underway following an officer-involved shooting.
According to authorities, it happened on the 1300 block of S. Espina St. Monday evening.
Officials confirmed the suspect has been taken into custody and received medical attention. LCPD also said no officers were injured.
The Dona Ana County Officer Involved Incident Task Force is investigating the shooting.
