Judge strikes down DA’s arguments on filing asking for her removal from office

EL PASO, Texas - Visiting Judge Tyron D. Lewis threw out several motions by District Attorney Yvonne Rosales in her efforts to halt a civil suit to remove her from office, court records show.

EL PASO Attorney Omar Carmona filed the civil suit on Aug. 24. Rosales responded by filing motions arguing how the petition had been filed incorrectly and should not be accepted, but Judge Lewis said the petition for removal stands.

ABC-7 reached out to the DA's office for an interview or comment on the Judge's dismissals and a spokesman declined to comment citing the fact that it's ongoing litigation.

Rosales also filed a request to have Judge Sam Medrano recused from hearing the Walmart shooting case on Friday. By doing so, any proceedings ordered by Judge Medrano in the Crusius case have been halted including a status hearing scheduled for Tuesday.

Rosales, an assistant district attorney and a municipal judge from Vinton were subpoenaed to appear in Judge Medrano's court Tuesday.

The recusal hearing has been scheduled for Sept. 19.
