NUMBER ONE CAMPAIGN FOCUS:
It is impossible to focus on one single issue within a small but very complex court system. A Justice of the Peace is not just a Judge, he or she is also a Magistrate.
Those two responsibilities not only effect civil cases and misdemeanors but also as a Magistrate you are called upon to handle cases involving the filing, and processing of felony complaints.
Many people and businesses are not aware of the different courts within the Justice of the Peace office. The Small Claims Court is guided by one code while the more complex Justice Court has rules of civil procedure that are used in County and District Courts. In the Justice Court section, you may file a suit for most anything including an eviction, which can be appealed all the way to the Texas Supreme Court after an appeal from County Court at Law. Most people who file civil cases in Precinct Seven do not have the money for attorney expenses and find themselves at a disadvantage most times. I can remedy that situation.
The criminal court within the Justice Court, hears cases ranging in fines from a few hundred dollars to tens of thousands. This represents a problem to most citizens and the disadvantaged. Many in Precinct Seven appear before the judge and prosecutor without legal assistance and receive fairly high fines which most cannot pay. The complexity of the criminal court is varied and cumbersome if you do not have an attorney to represent you. Precinct Seven suffers from a large amount of failures to appear in criminal cases because defendants do not have the money to pay the fines. This bogs down the court calendar and in turn creates a new criminal charge against the defendant for failure to appear. I have a remedy for that situation.
I want to give all the people who appear before the different courts within the Justice of the Peace office an honest, speedy, and impartial hearing or trial by using both the letter and the spirit of the law. The court is not a cookie cutter operation where everybody receives the same fine for all criminal offenses, or an automatic Civil Judgment. There are always winners and losers in any court proceeding but with my knowledge and temperament I will dispense a proper, fair and speedy verdict according to law.
WHAT SETS YOU APART FROM YOUR OPPONENT?
My opponent Harold Shumate is an individual who states many an accomplishment on his website. Most are embellished or untrue. He has never voted in Texas in any election and he registered for the first time last July. He states that he has lived in Canutillo and the voting precinct all his life. So why does he have a current New Mexico driver’s license?
I have lived in this state, county and precinct seven for 27 years. I have voted in just about every election and given my help and service in many forms to the communities in El Paso County. I have over 40 years of experience in the law enforcement and legal fields while Mr. Shumate has very little or none. I can step right in to the office of Justice of the Peace and continue the people’s business without any delay for lack of knowledge and training. I don’t want to be “The Law West of the Rio Grande” as Mr. Shumate states on his political signs. I want to be a good and compassionate judge that makes the best legal decisions for all parties involved.
RELEVANT EXPERIENCE THAT QUALIFIES YOU FOR THE POSITION YOU SEEK:
1. I have studied and certified or licensed in civil and criminal law.
2. I have held positions of trust as a law enforcement official in city, county, state and federal agencies, and have been to court to testify in criminal matters hundreds of times.
3. I have held a private investigator’s license since 2001 and have been to court over a hundred times to testify about my findings.
4. I have know the law and represented and argued civil cases for my employers and clients hundreds of times in Small Claims and Justice Courts.
5. I have the experience as a Precinct 7 Chief Constable and the knowledge of how and what that office must do to service the Justice of the Peace office properly.
6. In the past, I served with, and worked for, the present incumbent judge as a Constable, clerk, and interpreter.
DESCRIBE A MOMENT THAT CHANGED YOUR LIFE:
Speaking as a military veteran, former law enforcement official and private investigator, there have been too many life changing moments to single out just one. I have had many life changing moments since the early 60’s because I am a human being who continues to grow in experience, knowledge and wisdom. I am a Christian who owes everyone respect and love no matter who they are or what status in life they hold. I have saved people from physically dying as well as have had people die in my arms. I have seen great suffering and tragedy as well as joy and happiness. I have helped to change people’s hearts and come closer to God and the spiritual part of living in this physical world. I believe that I must give to God what is God’s and to Cesar what is Cesar’s so that I can maintain a balance that is acceptable to God and to all who I encounter in my daily life.
I always wanted to be in the practice of law, but the majority of my path took me in the direction of law enforcement and being a first responder to face many dangers and other traumatic circumstances. I have no regrets for the opportunity given to me by the citizens to serve.
The law is just like human life, is not just words written in codes and statutes. It is alive and ever changing just like us. We might be in error at times just like the law, but we are in constant change like the revisions of law to live a better life guided by the best possible rules we can enact.
