Three Legged Monkey’s federal lawsuit against City, elected officials dismissed

The Three Legged Monkey’s lawsuit against the City and elected officials has been dismissed.

“The United States District Court for the Western District of Texas has issued a Memorandum Opinion and Order in the Three Legged Monkey lawsuit against the City of El Paso, Emma Acosta, John F. Cook, Ann Morgan Lilly, Susannah M. Byrd, Steve Ortega, and Joyce Wilson. The City’s Motion for Summary Judgment was granted and all of Three Legged Monkey’s claims against the City and the elected officials were dismissed with prejudice,” said Sylvia Firth, City Attorney for the City of El Paso.

In court documents, Three Legged Monkey owner Mike Armstrong had alleged that the City and Patriot Place breached a 20-year lease agreement with his bar.

Armstrong also claimed the defendants conspired to put him out of business.

According to Armstrong, his business was not in violation of any government codes, yet it was subjected to countless raids during operating hours. He closed the bar for good in November 2013.

He was suing the City and elected officials for $1.8 million.
