BREAKING: Tai Chan jury will be bussed to crime scene after opening arguments
ABC-7’s New Mexico Mobile Newsroom has learned jurors in the Tai Chan retrial will be bused to the crime scene after opening arguments but before any testimony.
Monday, a jury was selected in the retrial of Chan, a former Santa Fe County sheriff’s deputy accused in the 2014 shooting death of a fellow deputy during what authorities say stemmed from an alcohol-fueled argument.
99 potential jurors were summoned to appear in state district court in Las Cruces on Monday. 15 were selected for the retrial: three men and 12 women, including 3 alternates.
Jurors will have to decide if Tai Chan acted in self-defense or carried out a calculated murder when he shot and killed fellow deputy Jeremy Martin.
The shooting happened Oct. 28, 2014 at the Hotel Encanto, where the two deputies were staying overnight after transporting prisoners to Arizona.
Chan’s first trial ended in a mistrial when jurors failed to reach a unanimous decision.
Jurors will get to see the hotel, room 711, the 7th floor hallway and the stairwell where Chan and Martin allegedly fought moments before the deadlin shooting.
Last Friday, District Judge Fernando Macias granted Dona Ana County District Attorney Mark D’Antonio’s motion asking the judge to allow jurors to see the crime scene.
