Ex-Albuquerque Detective’s Rape Case In Jury’s Hands
ALBUQUERQUE, N.M.(AP) – A state district court jury is deliberating the case of a man accused of raping a 14-year-old girl when he was an Albuquerque police vice detective.
Timothy Chavez was indicted on November 12th, 2005, on charges of criminal sexual penetration and kidnapping. The jury received the case yesterday in Albuquerque. Chavez contends he and the girl had consensual sex at her home on April 22nd, 2005, after they became acquainted on a telephone chat line.
He says he thought she was 18 at the time. Prosecutors say the girl told Chavez he could come to her home, but she did not seduce him and did not want to have sex with him. Chavez was fired in July 2005.
