Some neighbors of convicted rapist Kenneth McMahon atThe Rest Home subdivisiontell ABC-7 he often walks suspiciously in their streets and often stops to peer into their homes. Some went as far as requesting McMahon be escorted on his walks.

Law enforcement officials tell ABC-7 he is not on probation and is not breaking any laws by taking a walk around the neighborhood. McMahon has a mental illness and has a right to be at The Rest Home receiving treatment, they said.

“He served his time and he’s not on probation, and there is no restriction we can put about where he lives or where he goes,” stated Bo Nevarez, with the Dona Ana Sheriff’s Department.

“We understand his rights, but we have rights as concerned parents, our children are living by a violent sex offender,” said one of the worried residents in response to Nevarez’s comment.

The Dona Ana County Sheriff’s Department checks on the whereabouts of McMahon every 90 days to make sure that he is living in his designated residence.
