Update: 3-Year-Old Dies From Injuries In Train Crash

A three-year-old New Mexico toddler is dead after train crash in Anthony, New Mexico Tuesday night.

New Mexico State police say Nadeen Tovar died at University Medical Cener.

Her two-year-old sister Desirae is still in critical condition at the hospital, as is the driver 19-year-old Daisy Perez. Relatives say she is 4 months pregnant. Officials say Perez was driving with a suspended license and had a warrant out for her arrest. It was not immediately clear why she had a warrant out for her arrest.

State police say Perez was on State Road 478 when she made a left turn on Gannet road, right in front of an on-coming train. The train reportedly clipped the back of the van, sending it spinnig.

According to authorities, the driver says she never saw the train.

Investigators say the other passengers, all from Vado, New Mexico, are in stable condition, including Nadeen’s mother, 23-year-old Senaida Tovar and her two nephews, 7-year-old Marcos Hernandez and 18-year-old Miguel Hernandez.

Officials at O’neal Produce, a company renting the space no more than 150 feet from where the crash happened, say one of their employees is related to those who were in the van.

They were reportedly bringing him dinner.

Burlington Northern Santa Fe Railway officials say by federal law, the conductors have to sound the horn before and while going through public crossings. They’re supposed to begin sounding the horn about a quarter mile from the crossing.

Residents we spoke with say they never heard the horn Tuesday night.

Anthony city officials say they’re looking into getting crossing gates for this intersection.

Perez could face felony charges once she is released from the hospital.

State police investigators say neither seat belts or child safety seats were used.

A person related to the driver tells ABC-7 there is pending litigation with BNSF on this matter.

Police don’t believe drugs or alcohol were factors in the crash.
