Marmolejo Back in Court
El Paso, TX – The retrial of accused killer David Marmolejo won’t begin until January at the earliest. The District Attorney, lawyers for Marmolejo and Judge Gonzalo Garcia met in court Thursday to discuss possible dates, but only came away with a time frame.
Marmolejo is accused of strangling his mother, Gloria, after an argument in July of 2009. She was apparently upset about him dating his stepsister. His first trial ended with a hung jury on Sunday.
Thursday in court, Judge Garcia suggested April 8 to begin jury selection for the retrial, but the date was not accepted. Marmolejo’s lawyers want to begin earlier. The prosecution agreed, settling on a time frame between late January and March.
A change of venue also came up. Marmolejo’s lawyers tried moving the case before his first trial, but they were denied. Thursday, Judge Garcia said he would consider a change of venue this time, after seeing how much coverage the first trial got. Another hearing to settle on a date is expected in a couple of weeks.
